{"id":20614,"date":"2009-06-07T00:00:00","date_gmt":"2009-06-07T00:00:00","guid":{"rendered":"http:\/\/emigrazione-notizie.org\/?p=20614"},"modified":"2009-06-07T00:00:00","modified_gmt":"2009-06-07T00:00:00","slug":"6598-caso-irem-east-lindsey-uniti-contro-la-libera-circolazione-dei-servizi","status":"publish","type":"post","link":"https:\/\/emigrazione-notizie.org\/?p=20614","title":{"rendered":"6598 CASO IREM-EAST LINDSEY: UNITI CONTRO LA LIBERA CIRCOLAZIONE DEI SERVIZI"},"content":{"rendered":"<p>20090202 13:04:00 redazione-IT<\/p>\n<p>The circolo PRC\/SE \u201cKarl Marx\u201d of Londra<br \/>\nItaliano \/ Inglese<\/p>\n<p>Le proteste dei lavoratori britannici contro il contratto d\u2019appalto della Total di East Lindsey alla ditta Jacobs, e del sub-appalto di questa alla ditta italiana IREM, mettono a nudo la falsita\u2019 di fondo di una delle tante promesse della deregolamentazione in Europa: ovvero che il libero mercato, e la libera circolazione dei servizi, creino benessere per tutti. Non si tratta di una critica generica al sistema di produzione capitalista e al neoliberismo. Qui le responsabilita\u2019 sono specifiche e precisamente individuabili.<\/p>\n<p>Tuttavia prima di entrare nello specifico, va subito chiarito un equivoco che la stampa, italiana e inglese, sta contribuendo ad alimentare: qui non si tratta di problemi derivanti dalla libera circolazione dei lavoratori, bensi\u2019 di problemi derivanti da quello che, in diritto comunitario, si definisce libera circolazione dei servizi. E\u2019 importante chiare questo punto, perche\u2019 e\u2019 evidente che su questo tema la destra xenofoba sta gia\u2019 costruendo un caso e una battaglia anti-immigrazione, mentre la forze liberiste tentano di ricattare le coscienze dei lavoratori accusandoli di egoisimo e di mancanza di solidarieta\u2019.<\/p>\n<p>La libera circolazione dei lavoratori non causa questo genere di tensioni, giacche\u2019 un lavoratore straniero \u2013 italiano, portoghese, o cinese che sia &#8211; impiegato nel Regno Unito, va tratttato a tutti gli effetti come un lavoratore inglese (salvo che un datore di lavoro decida di sottopagarlo o assumerlo in nero, cosa peraltro illegale), riducendo praticamente a zero il rischio di una concorrenza sleale all\u2019interno del mercato del lavoro.<\/p>\n<p>Detto cio\u2019 e\u2019 il caso di esaminare piu\u2019 da vicino i problemi legati alla questione IREM. Su questa vicenda il punto di vista del sindacato britannico e\u2019 molto chiaro. Una ditta straniera \u2013 la IREM appunto &#8211; avrebbe vinto una gara di sub-appalto per la costruzione di impianti petrolchimici nel Regno Unito. Secondo loro, cio\u2019 sarebbe accaduto in quanto la ditta italiana retribuisce i propri lavoratori meno di quanto previsto dai contratti collettivi nazionali di categoria britannici. Al momento non e\u2019 dato sapere quale sia il trattamento economico dei lavoratori italiani e portoghesi impiegati dalla IREM. Sappiamo pero\u2019 tre cose. <\/p>\n<p>In primis, sappiamo per certo che quand\u2019anche i lavoratori IREM fossero pagati meno di quanto previsto dai contratti collettivi inglesi (e addirittura meno di quanto previsto da quelli italiani), l\u2019impresa potrebbe continuare a godere di questo vantaggio competitivo a spese di tutti i lavoratori, inglesi (che perdono di competitivita\u2019 e posti di lavoro) e italiani (che sono competitivi in quanto sottopagati), senza che nessuno possa utilizzare alcuno strumento giuridico esistente per contrastare il suo operato. Infatti la disciplina comunitaria in materia, un misto tra disposizioni del Trattato CE (Articolo 49 e seguenti), direttive (in primis la Direttiva 96\/71 sui \u2018lavoratori distaccati\u2019), e sentenze della Corte di Giustizia della CE (da ultime le sentenze Laval e Viking del 2007 e le piu\u2019 recenti R\u00fcffert e Commissione v Lussemburgo del 2008), di fatto prevede che le ditte straniere (ad esempio l\u2019IREM) debbano rispetare solo la normativa del paese ospite (ad esempio il Regno Unito) che sia contenuta in disposizioni di legge &#8211; applicabili obbligatoriamente a tutti &#8211; e non in contratti collettivi, salvo che questi non siano validi erga omnes, ovvero universalmente applicabili a tutte le imprese e i lavoratori del settore al pari di una disposizione di legge.<\/p>\n<p>In secondo luogo sappiamo anche che, purtroppo, contro queste forme di dumping sociale i lavoratori, e i sindacati, possono ben poco.  In paesi come il Regno Unito, ma anche in Italia, i contratti collettivi non sono validi erga omnes, ed e\u2019 quindi impossibile pretenderne il rispetto da parte di imprese fornitrici di servizi come l\u2019IREM, alla stregua della norme di legge nazionali. Anzi, dopo anni di martellanti attacchi al sindacato e alla contrattazione collettiva (attacchi tutt\u2019ora in corso sia in Inghilterra che in Italia), la copertura degli accordi sindacali inglesi e\u2019 crollata a meno di un terzo dei lavoratori nazionali, mentre in Italia, pur essendo di gran lunga piu\u2019 alta,  non copre comunque la totalita\u2019 della forza lavoro. Paesi come l\u2019Italia sono sprovvisti di una normativa sui minimi salariali previsti per legge, mentra nel Regno Unito il salario minimo legale previsto dal Minimum Wage Act 1998, e\u2019 comunque troppo basso (5.73 GBP\/ora) per avere qualche utilita\u2019 in questo contesto. Ne\u2019 appare possibile che il sindacato possa contrastare qesta degenrazione della libera circolazione mediante il ricorso allo sciopero. Infatti, le sentenze Viking e Laval hanno anche il demerito di ricordare che gli scioperi, nazionali o internazionali, contro queste forme di delocalizzazione temporanea rischiano di essere ritenuti contrari al diritto comunitario, e di esporre quindi i sindacati e i lavoratori a salatissime multe e sanzioni.<\/p>\n<p>In terzo luogo sappiamo che in assenza di una presa di coscienza del mondo politico (a livello nazionale e sovranazionale) contro questo genere di dinamiche mercantili, episodi come quelli dell\u2019IREM rischiano di essere solo un piccolo anticipo di distorsioni economiche e sociali che ben presto si svilupperanno su scala mondiale, e non solo europea. Infatti, mentre i governi neoliberali non riescono a fornire risposte a questi problemi che maturano all\u2019interno dei 27 stati membri dell\u2019UE, in seno al WTO si sono gia\u2019 avviate trattative e accordi (il cosi\u2019 detto GATS &#8211; General Agreement on Trade in Services, in cui specie i \u201cMode 3\u201d e \u201cMode 4\u201d sembrano replicare, in grande, la libera circolazione dei servizi CE), per consentire una libera circolazione dei servizi su scala globale.<\/p>\n<p>In questa concorrenza sleale, chi ci guadagna sono solo le imprese committenti e quelle intermediarie. Chi ci perde sono i lavoratori, sempre meno protetti e sempre peggio retribuiti in questa corsa al ribasso, e quelle imprese che rispettano i diritti dei lavoratori. Ma ci perdono anche i consumatori e i cittadini, che alla fine pagano il costo di tutte queste intermediazioni dal dubbio significato economico, e gli stati nazionali, che quando non sono impotenti sono complici di fronte a questa erosione sociale ed economica.<\/p>\n<p>Le soluzioni per uscire da questo apparente vicolo cieco ci sono, e sono state da sempre sostenute dal mondo sindacale (almeno da quello non subalterno all\u2019ideologia neoliberista) e dai partiti comunisti e della sinistra radicale, primi fra tutti Rifondazione Comunista. Va subito richiesto, e a gran voce,<br \/>\n\u00b7\tl\u2019introduzione di una normativa anti-dumping a livello nazionale, comunitario, e internazionale<br \/>\n\u00b7\til rispetto dei contratti collettivi nazionali, e una riprese vera della contrattazione collettiva europea, anche sui temi del salario,<br \/>\n\u00b7\til rispetto del diritto di sciopero e dello sciopero di solidarieta\u2019, a livello nazionale e trasnazionale<br \/>\n\u00b7\tla sospensione del GATS, e l\u2019introduzione di una \u2018clausola sociale\u2019 negli accordi del WTO.<\/p>\n<p>Il circolo PRC\/SE \u201cKarl Marx\u201d di Londra, esprime la sua solidarieta\u2019 a tutti i lavoratori coinvolti in questa vicenda. A prescindere dalla nazionalita\u2019 sono loro le vittime principali delle politiche neoliberiste nazionali e internazionali.<\/p>\n<p>Firmato: Il Circolo PRC\/SE \u201cKarl Marx\u201d di Londra rifondazioneuk@googlemail.com<br \/>\n1 Febbraio 2008<\/p>\n<p>__________________<\/p>\n<p>THE IREM-EAST LINDSEY CASE<br \/>\nUNITED AGAINST FREE MOVEMENT OF SERVICES<\/p>\n<p>The recent wave of protests against the Total-Jacobs-IREM contract in East Lindesy are yet another proof of the underlying falsity of one of the many promises of deregulation in Europe: that free market, and free movement of services, can create wealth and wellbeing for everyone. Ours, however, is not a generic tirade against the evils of the capitalist system of production and neoliberism. In this controversy the political culprits are very specific and easily discernible. <\/p>\n<p>However before entering into the details of the matter, we must immediately clarify a misunderstanding that the press, both in Italy and in the UK, is currently generating. We are not confronted with a set of problems deriving from free movement of workers here. Instead we are facing problems emerging from what, in Euro-jargon, is defined as free movement of services. It is very important to be clear about this point, as it is evident that on this fundamental misunderstanding the xenophobic right is building a case against immigrants and foreign workers, while neoliberal and conservative apparatuses are trying to break up the labour front by playing workers against each other and accusing them of selfishness and lack of solidarity. Free movement of workers does not cause this sort of tensions, since a foreign labourer working in the UK must be treated exactly as a domestic worker, and this of course reduces drastically the risk of an unfair competition within the British labour market. <\/p>\n<p>Having said that, we should examine a bit more closely the problems arising from the IREM  East Lindsey dispute. On this matter the viewpoint of the British labour movement is quite clear. A foreign company \u2013 that is to say IREM \u2013 has won a works contract in the UK. According to them, this happened because the Italian company pays its workers lower rates of pay than the ones provided by the relevant, British, sectoral collective agreements. Right now we do not yet know under what terms and conditions the Italian and Portuguese workers of IREM actually work. But there are three things we know for sure.<\/p>\n<p>Firstly, we know for sure that even if IREM workers were indeed paid less than what specified in the British collective agreements (and for that matter even less than what is provided by the Italian ones\u2026), the company could keep benefitting from this unfair competitive advantage at the expenses of all workers concerned, both British (that lose their competitive edge and their workplaces) and Italian (that only remain competitive as long as they are underpaid), without anyone being able to take up any legal action to bring it to account. That is because the relevant EC regulatory framework, a mix of EC Treaty provisions (Article 49 and following), directives (first and foremost the Posted Workers Directive 96\/71), and European Court of Justice judgements (Viking and Laval of 2007 and the more recent R\u00fcffert and Commission v Lussemburgo of 2008), effectively provides that foreign companies providing their services abroad (such as IREM) must only comply with those rules of the Host Country (for instance the UK) that are actually contained in legislative provisions, but not necessarily with those provided by collective agreements, unless the latter have erga omnes effects that is to say they are universally applicable to all business and workers operating in the sector..<\/p>\n<p>Secondly, we know that, unfortunately, there is very little that workers can do against these forms of social dumping. In countries like the UK, but also in countries like Italy, collective agreements do not have erga omnes effects, and it is therefore impossible to force them upon recalcitrant foreign companies such as IREM, as one may do with domestic statutes.   Far from that being possible, decades of neoliberal attacks on trade union rights and collective bargaining have reduced the coverage of UK agreements to less than a third of the workforce, whereas in Italy the coverage \u2013 while higher \u2013 is still not such as to apply to the whole workforce. Countries like Italy are not equipped with statutory minimum wage provisions, whereas in the UK the meagre rates provided by the MWA 1998 are too low to be of any help in situations like the one we are confronted with. Moreover unions cannot even rely on their industrial muscle to contrast this degeneration of free movement. The Viking and Laval judgements were an unwelcomed reminder of the fact that any industrial action against these forms of temporary delocalization may well result in a breach of community law, thus exposing unions and workers to serious financial sanctions and liabilities.  <\/p>\n<p>Thirdly we know that unless the political world (nationally and supranationally) matures an awareness against these mercantile degenerations of free movement, episodes such as the IREM-East Lindsey controversy are likely to be remembered as the first timid step towards a generalised, and this time global, problem. Indeed while neoliberal governments are failing to address these unfair practices emerging within the 27 EU Member States, the WTO has already set up a number of mechanisms and agreements (first and foremost the so called GATS &#8211; General Agreement on Trade in Services, with \u201cMode 3\u201d e \u201cMode 4\u201d dangerously replicating, on a global scale, EC free movement of services provisions), aimed at allowing a certain degree of free movement of services on a global scale.<\/p>\n<p>In this context of European and global unfair competition, the only winners are the corporations involved in these transantional tendering processes. The big losers are the workers, whose protection and wages are continuously eroded by this relentless race to the bottom. But consumers and citizens also lose out, as they will eventually have to pay the bill for all these rather dubious chains of contracts. National states are the other victims \u2013 and sometimes the actual accomplices &#8211; of this progressive process of social and economic erosion.<\/p>\n<p>It should be pointed out that there are several ways out of this dead end road, and they have always been upheld by the trade union world (at least by that part that is not subservient to neoliberal ideology) and by the communist and radical parties worldwide, first and foremost by Rifondazione Comunista. We must ask for:<\/p>\n<p>\u00b7\tThe introduction of national, European and international anti-dumping regulatory mechanisms<br \/>\n\u00b7\tThe respect of national collective bargaining, and the adoption of genuine collective agreements on pay coordination at a European level<br \/>\n\u00b7\tThe respect of the right to strike and of solidarity and sympathy action, at a national and transnational level<br \/>\n\u00b7\tThe suspension of GATS, and the introduction of a \u2018social clause\u2019 in the WTO agreement.<\/p>\n<p>We, the circolo \u201cKarl Marx\u201d of Rifondazione Comunista in London, would like to express our sympathy and solidarity to all the workers involved in the IREM\/East Lindsey dispute.
